1. The scope and validity of the conditions
1.1. All following conditions apply to all persons and any legal relations upon making purchases from ONOFF webstore.
1.2. In addition to these conditions the purchase from ONOFF webstore is regulated by the legislation valid in the Republic of Estonia.
1.3. ONOFF Online OÜ has the right to withdraw from the sales agreement and not to deliver the ordered products or provide the promised services in the following cases:
1) the product has run out of stock;
2) the product price or information has been displayed incorrectly due to a system error.
If ONOFF Online OÜ is not able to provide the products or services, then the customer will be contacted and the order sum will be transferred back to the client, if the client has managed to pay at that moment.
1.4. ONOFF Online OÜ has the right to change and modify the conditions and price lists due to the continuous developing of the webstore. The customers will be informed about these changes on the web-page www.onoff.ee. These changes will be valid from the moment of getting public on the web-page. In case you have made your order before the changes are applied, the conditions that were valid at the moment of you placing the order are applied if the law or conditions do not state otherwise.
2.1. All prices in ONOFF webstore are valid on due payment as stated in paragraph 4.
2.2. All prices include VAT 20%.
3. Shopping cart and checkout
3.1. Choose the delivery option suitable for You. With reference to the chosen delivery option, the shopping cart may ask additional information about the delivery destinaton.
3.2. After choosing the delivery option - payment options are shown. Choose the payment option best suitable for you.
3.3. After choosing a payment option - fill in personal information
3.4. Please be careful when filling in your personal information as it will play a vital role in delivering Your goods on time.
3.5. The sales agreement is considered final when the payment has been made to the account of ONOFF Online OÜ.
4.1. In order to make the payment please choose the suitable way.
4.2. Payments can be made as follows:
1) via internet bank (Swedbank, SEB links, Danske Bank and Nordea);
2) credit card;
3) leasing (ONOFF Järelmaks).
4.3. The order will be cancelled if the payment has not arrived in 7 days.
5. Product delivery
5.1. After the finalization of the agreement as determined in paragraph 3.5. the goods will be delivered to the place determined by You.
5.2. The courier will deliver the products with instruction manuals in estonian and other product documents in 3-7 workdays.
5.3. When You chose delivery by DPD and the order has been handed over to the courier company, the courier company’s representative will call you within the delivery time stated in paragraph 5.2 to agree on exact delivery time. Products that weigh more than 5 kg are delivered to in front of the house/apartment building.
5.4. The courier will deliver the goods on the address stated in the order. It is not possible to change it while the order has been made.
5.5. Please double check that your contact information is correct to avoid misunderstandings and delay of delivery. ONOFF Online OÜ and the courier company are not responsible for delay in delivery and misunderstandings that are caused by incorrect contact information presented by you.
5.6 The goods will be delivered by the courier with a delivery note. We strongly suggest to check the package before you sign it and mark possible damages of the package on the delivery note. We also kindly ask you to inform us about damage packages on the address: email@example.com or call ONOFF Online OÜ customer service: 662 1155. Products in packages damaged by the courier company will be replaced.
6. Cancellation of the order and returning the product
6.1. You have the right to cancel your order after making the payment but before the delivery by sending a corresponding message with the order number and your bank account data to firstname.lastname@example.org or by calling the customer service 662 1155.
6.2. After the delivery you have 14 days to decide if you are satisfied with the product. if you decide during this period that the product does not meet your needs you can return it or exchange it by sendind a corresponding message with the order number to email@example.com or by calling the customer service 662 1155. Computer games, computer programs and hygiene products cannot be returned. In case of large products ONOFF will order the courier company for pick-up on the mentioned address.
6.3. In case of order cancellation as determine in paragraph 6.1 or paragraph 6.2 the paid sum will be returned. You only have to pay the cost of returning the product in the amount up till 10 EUR (see paragraph 6.5). Thee money will be returned to your account latest within 30 days from receiving your cancellation message on the condition that you have returned the goods as determined in paragraphs 6.4, 6.5 and 6.6.
6.4. The returned product has to include all parts that were initially in the box. In case the purchase included extra products handed out during a campaign for free you have to return these as well.
6.5. ONOFF webstore has the right to charge the sum up to 10 EUR for the transport of the returned products.
6.6. In case the the returned product and/or the package have been damaged not by fault of ONOFF but by wrong usage of the goods by the customer ONOFF Online OÜ has the right to deduct the amount corresponding to the reduced value of the goods from the sum returned to the customer. In such case ONOFF will send on your e-mail a corresponding proposal. In case you do not agree with the deduction you have the right to use an independent expert for specifying the damage. The cost of the expertise will be divided by you and ONOFF. In case the opinion of one party is proved wrong all cost will be covered by this party.
7. Guarantee and returning of products that do not meet standards
7.1. ONOFF OnlineOÜ takes responsibility for shortcomings and errors that appear within 24 months from the delivery of the goods.
7.2. ONOFF will not take responsibility in the following cases:
1) the product has been damaged by the customer;
2) shortcomings that have appeared due to wrong usage of the product;
3) The product has physically worn off due to normal usage.
7.3. In case the product does not meet the requirements set or has other shortcomings, then you have the right to demand replacement of the product or cancel the order and return the defective product. Transport is paid by ONOFF.
7.4. Upon the return of a defective product the full sum (including transport) will be returned to you bank account latest within 30 days from receiving the notice about cancelling the offer and returning the product.
8. Responsibility and Force Majeure
8.1. ONOFF Online OÜ and you take mutual responsibility for damage caused to the other party by violating these terms and conditions as determined by the legislation of the Republic of Estonia.
8.2. ONOFF Online OÜ does not take responsibility for damage caused to you or delay of the delivery if it is caused by circumstances ONOFF Online OÜ has no power to change and cannot foresee i.e. force majeure.
9. Other conditions
9.1. All personal information connected to purchases in ONOFF webstore is considered confidential. Encrypted communication channels with banks guarantee the safety of personal and banking data. ONOFF Online OÜ has no access to bank information.
9.2. Questions and cases not determined in these conditions will be settled according to the legislation valid in the Republic of Estonia.
9.3. Disputes between you and ONOFF Online OÜ on the matters related to the webstore will be settled by negotiations. In case the agreement is not reached you have the right to turn to the Customer Protection Board ot Tallinn City Court. Disputes are solved according to the valid legislation in the Republic of Estonia.
9.4. Products sold in ONOFF Online OÜ webstore are not meant for resale by legal persons. Such orders will be rejected.
9.5. ONOFF guarantee is not valid for products resold by legal persons.
10.1 Product pictures have illustrative meaning.
10.2 Product prices and availability can change without advance notice.
